Disagreement on cleanup costs for recycling business

Stephanie Reichling, CBC Recycling owner, who was found guilty of contempt of court March 26 for failing to clean up the former recycling site at 13th and South Saginaw streets, appeared before Judge Herman Marable in 68th District Court April 27 trying to avoid a 75-day jail sentence.
Her attorney, Jeffery Chimovitz, told the judge his client received $11,000 from her bankruptcy trustee to clean up the site. He said she contracted with a local excavating firm to have the eyesore cleared in three days.
Angela Watkins, city attorney, told the judge she wanted proof in writing that the firm would take care of the problem in three business days. The city estimated the cleanup would take more than $100,000 and several weeks. She said she had no objection to a sentencing extension.
"I am stunned that a measly $11,000 could resolve this long and persistent problem," Marable said. "It could have been cleared up a while ago."
Marable noted that neighbors put up with trash blowing into their yards and firefighters and emergency response people put their lives in jeopardy when the site was set on fire in an earlier arson. The eyesore is a continuing hazard to the railroad lines that run adjacent to the property.
Marable extended the case until 9 a.m. May 1 when he said he would note any progress made. If there was none, he said, Reichling would start serving jail time at 4:30 p.m. as cited in his earlier judgment.
Previously, Marable sentenced Reichling to 75 days in Genesee County Jail beginning May 1 unless the site was cleaned up before April 16.
David Caswell of the Citizens Nuisance Task Force said he had recently been by the site and the absolutely nothing had been done.
