CBC Recycler judge removed from case

Members of the Citizen's Nuisance Task Force went to 68th District Court Judge Herman Marable's courtroom May 22 to follow up on the case against Stephanie Reichling, former owner of CBC Recycling, but found the case had been taken away from Marable.
Marable previously ordered Reichling to clean up the hazardous site at 13th and South Saginaw streets or face jail time.
"I came early to Marable's courtroom and his clerk told me that the case had been sent to Judge Cathy Dowd," said David Caswell, a member of the task force.
"Dale Scanlon (a member of the task force) and I were the only ones in Judge Dowd's courtroom. We spoke with her and she said she just received the case today. She had no details of what it involved," Caswell said.
Caswell and Scanlon then went to the city attorney's office.
"No one could tell us why the judge had been changed. Marable had been on the case since Feb. 7, 2011 — about 15 months," Caswell said.
"Judge Dowd scheduled another hearing for May 29 but no indication of the time was given," Caswell said.
Earlier in the week, the Flint Housing Commission asked the courts to file a contempt charge against Marable for his handling of a landlord-tenant dispute in an Oct. 7, 2011 case that lingered for months in his courtroom without a resolution.
A Genesee circuit judge ruled May 21 Marable would not be held in contempt, but that he must change his ruling on the contentious eviction case.
Marable's attorney called the contempt charge a politically motivated attack on the judge.
